Terms and
Conditions
The Service is provided by All Weather Dog Walkers (AWDW)
and anyone working on AWDWs behalf.
The Client is the Owner
of the dog, or the empowered representative of the Owner.
All
Clients will be deemed to have accepted AWDWs Terms and
Conditions on Completion of a Dog Contact Form &/or by
commissioning AWDW to undertake any Service. A Dog
Contract &/or any form of written instruction/agreement completed electronically and
received via the Clients
email address is deemed to be signed.
AWDW will
not confirm any booking or provide any service until there
has been a meet and greet consultation with the Client and
the dog. The client agrees to pay AWDW any fee specified.
The
Client must disclose all material information to AWDW about
the dog and advise any new or changes to such material
information throughout the period when AWDW undertake
Services for the Client:
any behavioural, injury or medical
condition including issues such as anti-social
behaviour, aggression, the need to be muzzled, conditions
such as incontinence, vomiting, diarrhoea,
travel sickness and mobility problems
any obedience training issues such as
unreliable recall and pulling on the lead
any prey drive or chase instincts that
could cause injury, distress or alarm to people or animals,
or damage to property
AWDW
reserve the right to refuse to provide Services for any dog
which AWDW consider to be unsuitable for such services.
Failure on the part of the owner to disclose any matter
which would make the dog unsuitable for walking will also
terminate the agreement.
The
Client will ensure their dog is wearing a suitable collar or
harness and provide a suitable lead. The Control of Dogs
Order 1992 requires all dogs in a public place to wear an
identification tag displaying the owners name and address
including postcode. AWDW reserve the right to refuse to walk a dog
if the method of control or restraint is unsuitable or if
the dog it is not
wearing a correct ID tag. The Client will be liable for any
fine or penalty for breach of The Control of Dogs Order
1992.
It is the
Clients responsibility that the equipment provided to
control the dog is safe and secure. AWDW will not be liable
for any faults in this equipment which results in an
accident or injury or damage to property.
The
Clients dog will be walked on a lead unless prior
arrangement has been agreed with AWDW and the Client has
signed a disclaimer authorising the dog to be exercised off
lead.
The
Client must provide AWDW with a name and contact telephone
number of someone empowered to make decisions relating
to the dog in an emergency. In the event that AWDW are
unable to contact the Client or a nominated representative,
the Client empowers AWDW to make decisions on their behalf.
The Clients veterinary surgeon details will be recorded and,
where possible, they, or another veterinary surgeon, will be
contacted if AWDW are unable to communicate with the client or
their representative.
In the
event of an emergency, AWDW will make decisions and take
action to in the interest of the Clients dog and, when appropriate, AWDW will
seek the advice and guidance of a veterinary surgeon. The
Client accepts responsibility for all veterinary fees,
howsoever incurred.
AWDW will
not feed the dog, other than training treats/rewards, unless
otherwise requested by the Client and unless a suitable resting period
of at least one hour has passed before or
after exercise.
The Client
will ensure, and provide evidence at AWDWs request, that
the dog is regularly
vaccinated and treated for flea,
parasites and worms as advised by the Clients veterinary
surgeon.
The Client
must ensure access to their property to facilitate the
collection and return of the dog. Arrangements will be
agreed in advance relating to this access. AWDW will ensure
The Client's keys are carried and stored without reference to the
Clients address and will return keys on demand.
AWDW
reserve the right to shorten or terminate any Service due to unforeseen circumstances or extreme weather
conditions if the safety of any person or animal is at risk ie: sickness, injury, extreme temperature, thunder and
lightening etc.
AWDW
reserve the right to shorten
or terminate any Service
if the dog displays signs of sickness or distress or if the
dog's behaviour is deemed anti-sociable, dangerous or
uncontrollable.
AWDW
reserve the right to refuse to accommodate bitches in season
or un-neutered males if AWDW deem they will disrupt or
cause distress to other people or animals
The
Client must hold an insurance policy which will indemnify
the Client and/or AWDW jointly and severally in respect of
liability for the actions of the dog. AWDWs Public
Liability insurance does not cover the Clients liability. AWDW will refuse or terminate
Services for a Client which is
not so insured by either a specific pet or home insurance
policy.
AWDW will
not be held liable for any loss, injury or death of any
animal
either inside or away from the Clients household whilst in our care.
The
Client is responsible for restricting the dogs access
within their houseold particularly when it is likely the dog
could be dirty and wet. AWDW will not be held responsible
for any damage caused by the dog in its own household.
Visiting
Times
AWDW reserve the right to visit or collect the dog within a
60 minute window of the time(s) specified. AWDW's schedule is
occasionally unavoidably disrupted by animals
displaying unpredictable behaviour, injury or sickness
requiring our attention.
Equipment Hire
AWDW will
not be held liable for any loss, injury or death
or damage to property howsoever caused arising out of the
hire or use of any equipment, including but not limited to,
carpet cleaners, pressure washers, training collars or "dog
spy"cameras or any accessory or ancillary product. Any
labour supplied by or through AWDW in connection with the
hire, supply or use of such equipment is deemed to be
responsibility of the Client as if such non bona fide
persons were the vicarious responsibility of the Client.
Dog Food
The Client accepts responsibility for the storage,
handling and feeding of any product supplied by AWDW and the
Client agrees that such products are supplied as "not fit
for human consumption". AWDW will
not be held liable for any loss, injury or death
or damage to property howsoever caused arising out of the
storage, handling or feeding of such products or any
relabelling or process or reselling of such products.
Cancellation Policy
Bookings for Services or Sales which are cancelled by the Client with less than 48
hours notice will attract the full price as though the
service or sale had taken place.
For recurring/rolling bookings, the Client must provide 7
days notice if two or more bookings are to be cancelled (ie
for holidays).
Any request to deviate from prearranged or regular times
will be subject to availability.
Variations to this cancellation policy are at the discretion
of AWDW and will not be based upon any precedent.
AWDW reserve the right to cancel the contract at any time
Payments
All bookings will be paid in advance or on the day of the
Service unless an alternative arrangement has been agreed.
Payment can be made by Electronic Bank Transfer or Cash.
For Late Payment, 2.5% of the total amount outstanding will be
added for each day that payment is overdue.
If a booking has been paid and is subsequently cancelled
AWDW will refund the full amount unless the cancellation
criteria is applicable. (see cancellation policy above).
AWDW reserve the right to alter charges/fees at any time.
